These Regulations set out the rules for the provision of electronic services by the Service and were drawn up based on Article 8 (1) (1) of the Act of July 18, 2002, on the provision of electronic services (Journal of Laws of 2017, item 1219, as amended). The Regulations are made available free of charge through the Service, providing the opportunity to review their content before concluding an agreement.
The Service operates under the address: trustedeconomyforum.com and is run by OBSERWATORIUM.BIZ sp. z o.o., with its registered office in Poznań (60-537) at Kościelna 37 Street, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Poznań Nowe Miasto and Wilda in Poznań, VIII Economic Department of the National Court Register under the number: 0000546490, NIP: 7792428710, REGON: 360917490. Contact with the Service is possible through an electronic form located at: trustedeconomyforum.com, e-mail: contact@trustedeconomyforum.com or in writing at the address of the Service’s headquarters.
§1.
DEFINITIONS
Service – OBSERWATORIUM.BIZ ap. z o.o. with its registered office in Poznań (60-537) at Kościelna 37 Street;
Participant – a natural person participating in a Webinar or Conference organized by the Service;
User – a natural person using the Service;
Consumer – a natural person who is a consumer within the meaning of Article 221 of the Civil Code, i.e., a natural person who purchases a service for a purpose not directly related to his/her professional or business activity;
Terms and Conditions – these rules and regulations for the provision of electronic services;
Conference – an event taking place on the date and place indicated in the Service, consisting of a conference part and, if it follows from the content of the Service, a workshop. Participation in the event is possible after registration and payment of the fee according to the rules described in the Terms of Service;
Webinar – online seminar organized by the Service for Participants, using an online seminar application selected by the Service. Participation in the event is possible after registration and payment of the fee according to the terms and conditions described in the regulations;
§2.
USING THE SERVICE
- The Service makes available free of charge the content contained therein, unless the provisions of the Terms of Service state otherwise. The User may use the Service 24/7.
- The provision of unlawful content by the User is prohibited. If the Service receives an official notice or credible information about the unlawful nature of the stored data provided by the User, the Service may prevent access to such data.
- The Service is not responsible for non-delivery of e-mail with information on order processing, if the above is caused by reasons attributable to the User (e.g., overflowing email box).
§3.
PLACING AN ORDER FOR THE WEBINAR OR CONFERENCE SERVICE
- The participant is required to read the Terms and Conditions and confirm his/her acceptance by making a statement – checking the appropriate checkbox. The Participant can make declarations of consent to conduct direct marketing of services and receive commercial information electronically from the Service and its business partners. The expression of consents is voluntary.
- The event registration is done through the online system registration form through the Service. The number of places for a Webinar or Conference may be limited.
- Payment for the service is made through one of the methods available on the website as indicated by the Service:
- electronic bank transfer (pay-by-link, BLIK, transfer to an account);
- payment cards (Visa, Visa Electron, Mastercard, Mastercard Electronic, Maestro);
- installment payments.
- The entity providing online payment services is Autopay S.A.
- Service allows the possibility of organizing promotions and discounts related to the fee for participation in the Webinar or Conference. Upon receipt of confirmation of participation in the Webinar or Conference, an agreement for the provision of electronic services is concluded.
§4.
IMPLEMENTATION OF THE SERVICE AND RULES OF PARTICIPATION IN THE WEBINAR OR CONFERENCE
- To use the Service, a computer or other electronic device with Internet access and appropriate software, including an Internet browser, is required.
- The Service may provide an opportunity to interact with the speaker or other Participants through chat communication.
- The Participant agrees to use the Service in accordance with the law, without violating the
rights and good name of third parties. - The Service may record, share, and archive the course of the Webinar or Conference.
- The Service reserves the right to make changes to the Webinar or Conference program or the technical conditions of its organization for important reasons, which will not constitute a violation of the Terms and Conditions.
- The Service is not responsible for circumstances occurring on the part of the Participant that will prevent him/her from participating in the Webinar or Conference, including in particular:
- incorrectly provided contact information,
- failure of the Participant to meet the technical conditions necessary for the service,
- malfunction of data communications equipment.
§5.
COMPLAINTS
- The User may file a complaint related to the performance of the service by the Service. A complaint may be submitted in electronic form to contact@trustedeconomyforum.comor in writing to the Service’s headquarters address.
- A person filing a complaint should provide his/her data, including contact details and a description of the reason being the basis of the complaint. Complaints that do not meet these requirements will not be considered.
- The service will consider the complaint no later than within 14 days (about 2 weeks) and will respond to the e-mail address provided in the complaint.
§6.
WITHDRAWAL FROM THE CONTRACT. CONSUMERS
- The right to withdraw from the contract under this paragraph applies only to the Consumer.
- The Consumer may, within 14 days (about 2 weeks) from the date of conclusion of the contract, withdraw from the contract without giving any reason.
- The consumer withdraws from the contract by submitting a statement of withdrawal to the Service. To meet the deadline, it is sufficient to send the statement before its expiration.
- Reimbursement of the fee paid by the Consumer will be made immediately, no later than within 14 days (about 2 weeks) from the date of receipt of the Consumer’s statement of withdrawal from the contract.
- The right of withdrawal does not apply to the Consumer with respect to contracts where the Service has performed the service in full of the express consent of the Consumer, who has been informed that after the Service has performed the service, he will lose the right to withdraw from the contract.
- Information on the possibility of the Consumer to use out-of-court procedures for processing complaints and pursuing claims, as well as the rules of access to these procedures, is available on the following websites of the Office of Competition and Consumer Protection:

The Consumer can also obtain information at the offices and websites of county (city) consumer ombudsmen, social organizations whose statutory tasks include consumer protection and Provincial Inspectorates of Commercial Inspection.
- In particular, the consumer has the following possibilities to use out-of-court ways of dealing with complaints and claims:
- the possibility of applying to a permanent amicable consumer court operating at the Trade Inspection,
- the possibility of applying to the provincial inspector of the Trade Inspection to initiate mediation proceedings for an amicable conclusion.
The Service informs that at http://ec.europa.eu/consumers/odr/ there is a platform for online dispute resolution between consumers and businesses at the EU level (ODR platform).
§7.
INTELLECTUAL PROPERTY
- Upon conclusion of the Agreement, the Participant shall obtain the right to access the content of the Webinar or Conference for the duration of their duration. The content constitutes a work within the meaning of the Act of February 4, 1994, on Copyright and Related Rights (Journal of Laws of 2016, item 666, as amended), and is intended for the Participant’s personal use. The Participant does not have the right to reproduce, duplicate, distribute, market the content of the Webinar or the Conference or the materials from the Webinar (Conference), or to make such content available to third parties.
- Participants have no right to record the content and proceedings of the Webinar or Conference without the Service’s written consent.
§8.
LIABILITY OF THE SERVICE
- The Service assumes no responsibility for any interference during the Webinar or Conference.
- The Service stipulates that the content provided during the Webinar or Conference is for informational purposes only and cannot be considered professional advice. In particular, the Service is not responsible for:
- for any damages caused by inaccuracies in the information obtained by the Participant during the Webinar (Conference);
- for any damages caused by cancellation or postponement of the Webinar (Conference).
§9.
PROTECTION OF PERSONAL DATA
- Pursuant to Article 13 of RODO, the Service informs as follows:
- The administrator of personal data is OBSERWATORIUM.BIZ sp. z o.o. with its registered office in Poznań at Kościelna 37 Street, the owner of the Service.
- For additional information related to the processing of personal data, the User may contact via e-mail: contact@trustedeconomyforum.comor by sending an inquiry to the Service’s address. The Service obtained the User’s personal data as a result of the User’s completion of the form or in connection with the User’s express and voluntary consent to its processing.
- The Administrator processes the User’s personal data to:
- enable the provision of electronic service and full use of the Website, including payment;
- to resolve technical problems;
- handling of complaints;
- handling of requests directed through the contact form;
- for tax and accounting purposes in connection with applicable laws in this regard;
- conduct marketing activities towards the User based on the User’s consent;
- to provide payment services;
- organization of promotional actions in which the User may participate with his/her prior consent;
- saving data in cookies – with the prior consent of the User.
- Consent to the processing of personal data may be withdrawn at any time through the contact form available at trustedeconomyforum.com or by email at – contact@trustedeconomyforum.com
- Provision of data is voluntary, however, if the User does not provide personal data, the Service will not be able to provide the service;
- The Service guarantees the observance of rights under the RODO, i.e., the right of access, rectification and deletion of data, restriction of data processing, the right to data portability, not to be subject to automated decision-making, including profiling, and the right to object to the processing of personal data.
- The rights referred to above may be exercised by the User if:
- with respect to a request for rectification of data, the User notices that the data is incorrect or incomplete;
- with regard to a request for deletion of data, when: the data will no longer be necessary for the purposes for which they were collected by the Service; the User has withdrawn his/her consent to the processing of data; the User has objected to the processing of data; the User’s data will be processed unlawfully; the data should be deleted in order to comply with an obligation under the law;
- with respect to a request for restriction of data processing, when: the User’s data will be processed unlawfully, but the User does not want it deleted; the User’s data will not be needed by the Service, but may be needed by the User to defend or assert claims; the User raises an objection to data processing – until it is determined whether the legitimate grounds on the part of the Service override the grounds for the objection;
- regarding a request for data transfer, when: the processing of the User’s data takes place based on consent or a contract concluded with the User, and when such processing is done by automated means.
- The User has the right to lodge a complaint in relation to the processing of his/her personal data to the supervisory authority, which is the President of the Office for Personal Data Protection (address: Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).
- You have the right to object to the processing of your personal data when your personal data is processed for direct marketing purposes, including profiling for this purpose.
- The Service shall store personal data for the duration of the contract concluded with the User, as well as after its termination, for a maximum period of 6 years from the date of completion of the contract, for the purposes of:
- performance of obligations under the law, including tax and accounting,
- statistical and archiving,
- marketing for the duration of the contract or until the User objects to such processing, whichever occurs first.
§10.
FINAL PROVISIONS
- The Service reserves the right to make changes to the Regulations. The Service will inform you about the content of the changes to the Regulations on the website at least 3 days before the changes come into effect.
- In the case of a dispute arising because of an agreement for the provision of electronic services, the Website and the Participant will seek to resolve the matter amicably. The law applicable to the resolution of any disputes arising under these Regulations shall be Polish law.
- The Regulations shall come into force on 15.05.2024.
